Course Description

The Supreme Court of the United States will be completing its 2022-23 term this summer.  In this course, we will read and discuss a selection of its most important decisions.  Cases likely to be considered involve a clash between the First Amendment and anti-discrimination laws when a website designer refuses on religious grounds to design a website for same-sex marriage ceremonies; the extent to which race may be considered in college admission decisions; and the so-called Independent State Legislature theory pursuant to which an election map enacted by the North Carolina legislature is said to be immune from a holding by that state’s supreme court finding that the map violated the state constitution.  There will also be follow-up discussion of last year's Dobbs decision and the subsequent confused mix of abortion decisions in the lower courts.
